This Privacy Policy explains how we collect, use, share, and protect personal information in connection with our real estate brokerage and mortgage brokerage services and through this website (dorianthebroker.com).
By using our website, submitting a contact form, opting in to SMS messages, or engaging us as your real estate or mortgage broker, you agree to the practices described in this policy.
1. Information We Collect
1.1 Information you provide directly

- Property and transaction information — property address, target search areas, budget, timeline, financing needs, current housing situation, and other details relevant to a real estate or mortgage transaction.
- Financial information — when applicable to a mortgage application: income, employment, assets, liabilities, credit authorization, and identification documents. This information is collected only with your express authorization and only when a mortgage transaction is contemplated.
- SMS consent records — if you opt in to SMS messages, we retain a record of your opt-in (timestamp, source, and the consent language presented to you).
- Communications — messages, emails, voicemails, and text messages you send us.
1.2 Information collected automatically
- Usage data — pages viewed, search terms, referring URLs, IP address, device type, and browser type, collected through standard website analytics.
- Cookies and similar technologies — small data files stored on your device to remember preferences and measure site performance.
1.3 Information from third parties
- Lead portals — when you submit an inquiry through Zillow Premier Agent, Realtor.com Readyconnect, Redfin, or similar real estate platforms, those platforms forward your contact details and inquiry to us.
- MLS and public records — property listing data, ownership records, and transaction history from the Multiple Listing Service and public county records.
- Credit bureaus — for mortgage applications, credit reports obtained with your written authorization.
2. How We Use Your Information
We use your information to:
- Respond to inquiries about properties, financing, or our services.
- Conduct our real estate and mortgage brokerage activities, including showing properties, drafting offers, processing mortgage applications, and coordinating closings.
- Communicate with you by phone, email, and (where you have opted in) SMS about your transaction or inquiry.
- Comply with applicable law, including California Department of Real Estate (DRE) and Nationwide Multistate Licensing System (NMLS) record-keeping requirements, the Real Estate Settlement Procedures Act (RESPA), and the Truth in Lending Act (TILA).
- Improve our website and services through analytics.
3. SMS Messaging Program
SMS opt-in is voluntary. Consent to receive SMS messages is not a condition of any purchase, sale, listing, or mortgage service. You may decline SMS and still receive full service through email and phone.
3.1 How you opt in
You opt in to SMS communications from Dorian the Broker only when you take one of the following affirmative actions:
- Check the SMS consent checkbox on our website contact form, which states: "I agree to receive SMS messages from Dorian Body-Lane regarding my real estate or mortgage inquiry. Message and data rates may apply. Reply STOP at any time to opt out. Reply HELP for help." The checkbox is unchecked by default.
- Submit a lead through a third-party real estate portal (such as Zillow or Realtor.com) whose terms of service include consent to be contacted by SMS by the matched real estate professional.
- Provide verbal or written consent during an in-person meeting, recorded in our customer relationship management system with timestamp.
3.2 What messages we send
SMS messages may include: replies to inquiries, appointment confirmations and reminders, document signing reminders, mortgage pre-approval status and renewal reminders, transaction milestone updates, and new listing alerts that match criteria you have specified. We do not send promotional or marketing blasts unrelated to your active inquiry or transaction.
3.3 Frequency, costs, and carriers
Message frequency varies based on the activity of your transaction. Standard message and data rates from your wireless carrier may apply. Carriers are not liable for delayed or undelivered messages.
3.4 How to opt out
You may opt out of SMS at any time by replying STOP, END, QUIT, CANCEL, UNSUBSCRIBE, or REVOKE to any message. You will receive a single confirmation that you have been unsubscribed and will not receive further SMS messages from this number. You may also request opt-out by emailing dorian@dorianthebroker.com. Opting out of SMS does not opt you out of email or phone communication; those must be requested separately.

4. How We Share Your Information
We share information only as needed to deliver our services or as required by law:
- Service providers — escrow, title, transaction coordinators, MLS, mortgage lenders, appraisers, inspectors, e-signature platforms, and our customer relationship management software (currently GoHighLevel / LeadConnector). These parties are contractually bound to use your information only to perform services for you.
- Lenders and underwriters — for mortgage applications, with your explicit written authorization.
- Regulators and auditors — the California Department of Real Estate, NMLS, and other regulators with lawful jurisdiction.
- Legal compliance — when required by subpoena, court order, or other legal obligation.
We do not sell your personal information. We do not share SMS opt-in or phone numbers with third parties or affiliates for their own marketing purposes. SMS consent is used solely to communicate with you about your inquiry or transaction.
5. Data Retention
We retain transaction records, including all communications and consent records, for the period required by California real estate and mortgage broker recordkeeping rules (generally three to seven years depending on document type), and for any longer period required by tax law, audit obligations, or pending legal matters. After the retention period ends, records are securely destroyed.
6. Your Privacy Rights
6.1 California residents (CCPA / CPRA)
Under the California Consumer Privacy Act (as amended by the California Privacy Rights Act), California residents have the right to:
- Know what personal information we have collected, used, and disclosed about you.
- Request deletion of your personal information, subject to legal retention requirements above.

7. Security
We use industry-standard administrative, technical, and physical safeguards to protect personal information, including encryption in transit (TLS/HTTPS), access controls on our customer database, and document retention systems with audit logging. No system is perfectly secure, and we cannot guarantee absolute security.
8. Children's Privacy
Our services are not directed to individuals under 18, and we do not knowingly collect personal information from minors. If you believe we have collected information from a minor, please contact us so we can delete it.
9. Third-Party Links
