These Terms of Service ("Terms") govern your use of dorianthebroker.com (the "Site") and the brokerage and informational services provided by Dorian I Body-Lane d/b/a Dorian the Broker, a California-licensed real estate broker (DRE #02041208) and mortgage broker (NMLS #1882339) ("we", "us", "our"). By using the Site, contacting us, or engaging us as your real estate or mortgage broker, you agree to these Terms.
1. About Our Services
Dorian the Broker provides real estate brokerage services and mortgage brokerage services to clients in California. Real estate brokerage is governed by the California Department of Real Estate; mortgage brokerage is governed by the Nationwide Multistate Licensing System and applicable state and federal law (including RESPA, TILA, and the SAFE Act).
This Site is for informational purposes. Information presented here, including listings, market commentary, and content describing the lending process, is general in nature and is not a solicitation to buy or sell a specific property, an offer of credit, or a binding commitment to provide brokerage services. A broker-client relationship is established only by a written agency agreement signed by both parties.

2. Use of the Site
You agree to use the Site only for lawful purposes consistent with these Terms. You agree not to:
- Submit false or misleading contact or transaction information.
- Impersonate any person or entity.
- Scrape, mirror, or systematically copy content from the Site without our written permission.
- Interfere with the Site's operation, including by introducing malware or attempting to bypass security controls.
- Use the Site or any communications from us for spam, harassment, or any unlawful purpose.
3. Property Listings and MLS Data
Listings displayed on the Site or referenced in our communications may originate from the Multiple Listing Service (MLS), public records, or third-party real estate platforms. Listing information is believed to be accurate at the time of display but is provided without warranty. Properties listed by other brokers are identified as such where required by MLS rules. Pricing, availability, and property details may change at any time without notice.
4. No Legal, Tax, or Financial Advice
Information provided through the Site or in conversations, emails, and SMS messages is general information about real estate and mortgage transactions. It is not legal advice, tax advice, accounting advice, or financial planning advice. We strongly recommend that you consult a licensed attorney, CPA, or financial advisor for advice specific to your situation, particularly for:
- Title and contract questions.
- Tax implications of buying, selling, or refinancing.
- Estate planning and ownership structuring.
- Investment property analysis.
5. Mortgage Disclosures
For mortgage brokerage services:
- Mortgage pre-approvals are conditional and subject to verification of the information you provide, satisfactory appraisal and title report, and lender approval at the time of application. A pre-approval is not a commitment to lend.
- Loan products, rates, and terms are offered by third-party lenders and may change without notice. We do not lend directly.
- All mortgage applicants are entitled to a Loan Estimate within three business days of submitting a complete application, as required by federal law.
- The Real Estate Settlement Procedures Act (RESPA) prohibits kickbacks and unearned referral fees. Any third-party service provider we recommend (escrow, title, inspection, etc.) is recommended on the basis of service quality and price; you may select any qualified provider you choose.
6. Communications and SMS Consent
By providing your contact information, you consent to receive communications from us by phone, email, and (where you have explicitly opted in) SMS, in connection with your inquiry or transaction. SMS consent is voluntary and is not a condition of any service.
Full details on SMS messaging — including opt-in language, message frequency, opt-out keywords, and how we handle SMS data — are set out in our Privacy Policy. To opt out of SMS at any time, reply STOP to any message.
7. Intellectual Property
All Site content (text, images, logos, design, code) is the property of Dorian the Broker or its licensors and is protected by U.S. copyright and trademark law. You may view and print Site content for personal, non-commercial use. Any other use, including reproduction, modification, distribution, or republication, requires our prior written consent.
8. Third-Party Links and Services
The Site may link to or integrate with third-party services (Zillow, Realtor.com, Redfin, MLS systems, lender portals, e-signature platforms, our customer relationship management system, the California DRE website). Those services are governed by their own terms and privacy policies. We are not responsible for their content, availability, or practices.
9. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Property descriptions, square footage, lot size, school district information, tax records, and other property-specific data are sourced from third parties and may be inaccurate. Buyers and sellers should independently verify all material facts before relying on them in any transaction.
10. Limitation of Liability
To the fullest extent permitted by law, in no event will we, our officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Site or our communications, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under California or federal law, including liability for fraud, willful misconduct, or violations of consumer protection statutes.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
12. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts. The Federal Arbitration Act, federal arbitration law, and (to the extent state law applies) California law shall govern the interpretation and enforcement of any arbitration provision contained in any separate written agency agreement.
13. Changes to These Terms
We may revise these Terms at any time. The "Last updated" date at the top of this page indicates when the most recent change was made. Continued use of the Site after a change constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
